Members are responsible for providing all personal computer and communications equipment necessary to gain access to www.eqxl.com. Access to and use of www.eqxl.com is through a combination of an ID and a password.

You agree to register details about yourself that are true and that you will never impersonate any person or entity. It is understood that all information posted publicly or privately transmitted through www.eqxl.com is the sole responsibility of the individual from which content originated. 6. Membership Fees

Membership to the online program is free for the first month then a monthly fee will apply.

Debt Payoff Accelerator reserves the right to modify pricing of, add to, or discontinue the Debt Payoff Accelerator service or any portion thereof without prior notice.

Membership may not be sold, assigned or transferred to any person or Entity. Members must promptly inform Debt Payoff Accelerator Manager of the following: changes in the expiration date of any credit card used in connection with the Service; changes in home or billing address; and apparent breaches of security, such as loss, theft, or unauthorized disclosure or use of an ID or password. Until Debt PayOff Accelerator is notified, by e-mail at info@eqxl.com of a breach in security, the Member will remain liable for any unauthorized use of www.eqxl.com.

When you cancel your account, no refunds will be issued.

7. Disclaimer

YOU EXPRESSLY UNDERSTAND AND AGREE THAT DEBT PAYOFF ACCELERATOR SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF DEBT PAYOFF ACCELERATOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) ARISING FROM YOUR ACCESS TO, OR USE OF, THE SITE OR ANY CONTENT, DOCUMENTS, MATERIALS, INFORMATION, SOFTWARE, PRODUCTS OR SERVICES DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SITE.

NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, IN NO EVENT SHALL THE CUMULATIVE LIABILITY OF DEBT PAYOFF ACCELERATOR EXCEED THE GREATER OF THE TOTAL PAYMENTS RECEIVED FROM YOU BY DEBT PAYOFF ACCELERATOR DURING THE PRECEDING TWELVE (12) MONTH PERIOD OR $100. FURTHERMORE, YOU AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF, RELATING TO, OR IN ANY WAY CONNECTED WITH ANY OF THE WEBSITE OR THESE TERMS OF USE MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH CAUSE OF ACTION SHALL BE PERMANENTLY BARRED.
